Dallas Jury Awards $4 Million Verdict for Family of Slain Armored Car Messenger

DALLAS, Oct. 2, 2013 /PRNewswire/ -- Dallas attorneys Daniel K. Hagood of Fitzpatrick Hagood Smith & Uhl and Van Shaw of the Law Offices of Van Shaw have won a $4 million wrongful death verdict on behalf of the family of an armored car messenger who was killed in a 2009 armed robbery in Dallas.

Mr. Hagood and Mr. Shaw represented the family of Cresencio Borquez in the jury trial heard in Judge D'Metria Benson's Dallas County Court at Law No. 1. Jurors unanimously agreed that JP Morgan Chase Bank was negligent in failing to provide adequate security outside a Dallas bank branch where Mr. Borquez was fatally shot.

A married father of two, Mr. Borquez worked as an armored car messenger for Brinks Security. He was killed in September 2009 while stocking an ATM outside the Chase branch in the 2500 block of Fort Worth Avenue.

During the trial, Mr. Hagood presented evidence that Chase was aware of crime and safety issues at the bank branch, as well as a similar armored car robbery in which the suspects were still at large. Mr. Hagood argued that Chase officials disregarded an obligation to notify Mr. Borquez and his employer about the dangers.

"A simple guard – simple measures – should have been done to protect this man's life, and they were not done," Mr. Hagood said in closing arguments in the wrongful death trial. "They walked away from their responsibility. This didn't have to happen given the notice to Chase. They knew of the dangers out there."

Enrique Lopez is serving two life sentences after pleading guilty to Mr. Borquez' murder in 2012. Jesus Sandoval is serving a 40-year sentence after pleading guilty in to a federal armed robbery charge.
