Who Has to Pay Attorney Fees in Divorce? Brad LaMorgese Family Law Attorney McCurley Orsinger McCurley Nelson & Downing, L.L.P. "Among the many laws that went into effect on Sept. 1 in Texas is an addition to the Texas Family Code stating that courts *may* award legal fees and expenses to be paid by one of the parties in a divorce. Courts typically have included legal fees as 'necessaries' that are part of one spouse's requirement to support the other while the divorce is pending. But the Supreme Court of Texas' May 2013 ruling in Tedder v. Aldrich declared that such fees aren't considered 'necessaries.' This new law was intended to address that finding and give courts permission to award fees. We're glad the legislature and Gov. Perry addressed the availability of legal fees in divorce, but the courts still have a lot of discretion to order – or *not* order – legal fees to be paid. Susan Melin, M.D. Associate Professor of Hematology and Oncology Wake Forest Baptist Medical Center "One of the first questions I get from my patients is, 'Am I going to lose my hair?' Being able to safely prevent chemotherapy-induced hair loss may relieve patients of some of the emotional stress they are already going through." Dr. Melin is primary investigator of a new clinical trial to test medical scalp-cooling technology for women undergoing chemotherapy for early stage breast cancer treatment. The FDA approved in June the Investigational Device Exemption (IDE) application for Dignitana's patented DigniCap System and a multi-center trial is underway. The trial is the second and final phase of study in the United States and will pave the way for FDA market approval of the scalp-cooling device, which is already widely used overseas. Lawrence J. Solin, MD, FACR, FASTRO Chair, Department of Radiation Oncology Einstein Medical Center Philadelphia "The detection of ductal carcinoma in situ (DCIS) is increasing in the United States, with more than 50,000 patients diagnosed each year. Of these women, the majority will not develop a local recurrence of DCIS or an invasive cancer in the same breast. Unfortunately, traditional clinical and pathologic criteria are insufficient to define a low-risk population for whom excision alone may be adequate. The DCIS Score is a new tool that can help physicians and patients make more informed decisions, and help identify which patients can be treated with surgical excision alone, allowing them to avoid radiation." Dr. Deborah ter Meulen Radiologist Nantucket Cottage Hospital, a Mass-General Affiliate Dr. ter Meulen is an expert radiologist, specializing in women's breast health. Over the past year, Dr. ter Meulen has reviewed 366 breast MRIs, while routinely assessing the corresponding mammography. Additionally, she routinely assesses 3D horizontal/transversal images and uses a kinetic curve assessment.
