The current litigation TorkLaw is focused on against Medtronic is related to the off-label uses of its InFuse Bone Graft product. In 2001, Medtronic applied for FDA approval and received the approval in 2002. Classified as a Class III medical device, the Infuse Bone Graft system was approved for use in anterior (through the abdomen) lumbar surgery only.
The Infuse Bone Graft system however, was promoted by Medtronic for "off label" uses that were not approved. A United States Department of Justice investigation revealed that over $60 million dollars was paid to promote this unapproved use.
